You the guest (the “Guest”) desires to engage Navajo USA LLC D.B.A. Navajo Tours USA (hereinafter, “Navajo Tours USA”) a New Mexico limited liability company (the “Company”) to provide certain cultural and active travel experiences (the “Services”). In consideration of, and as a material inducement for, Company’s agreement to provide the Services to Guest, Guest hereby acknowledges they have read and agree to the Acknowledgement of Risks, and understand the following.
Guest acknowledges that the exhilaration of the proposed Services is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to the enjoyment and excitement arising from participation in such activities. Guest understands that the Services may involve various outdoor activities, unfamiliar locations, and modes of travel and may expose Guest to additional physical dangers and risks inherent to outdoor activities, including without limitation physical exertion beyond the usual activities of Guest, walking through unfamiliar, narrow, unpaved and/or steep paths, gangways, roads and stairways, exposure to sudden weather changes and extremes, and exposure to wildlife, plants, and insects.
Guest assumes responsibility for their own negligence which may result in sunburn, dehydration, heat exhaustion, heat stroke, heat cramps, fatigue, bodily injury, death, or loss of personal property.
Guest understands that Guest is responsible for Guest’s behavior and safety, and at all times, will abide by and comply with any all safety and other instructions given by Company, its employees and agents. Company reserves the right to remove, without refund, any Guest who is abusive to its employees, other guests or third parties, or who it determines to detract from the enjoyment of the trip by others. Guest acknowledges that is impossible to list all of the hazards that are inherent in activities related to the Services and Guest knowingly and willfully accepts and assumes all such risks and dangers, whether or not specifically listed above.
